Conditions for Regulated Activity with Children in Specified Establishments

If you work in a Specified Establishment and meet all five of the following conditions, then:

  • You are considered to be in regulated activity with children, and

  • You can request a Children’s Barred List check on your DBS application.

You must meet all of these conditions:

  1. Frequency / Overnight Condition

    • You work in the establishment more than 3 days in a 30-day period,

or

    • You work once overnight between 2am and 6am, with the opportunity for face-to-face contact with children.

  1. Opportunity for Contact

    • Because of your job, you have the opportunity to have contact with children in the establishment.

  2. Purpose of the Establishment

    • You work there for the purpose of the establishment (for example, as part of its core activities, not just as a visitor).

  3. Not Temporary or Occasional

    • Your work is not temporary or occasional. It has some degree of regularity or continuity.

  4. Not a Supervised Volunteer Role

    • Your role is not a supervised volunteer position.

    • Supervised volunteers in these settings may not meet the definition of regulated activity.

If any one of these five conditions is not met, the role may not be considered regulated activity, and a barred list check may not be appropriate.
