Exceptions: When You Still Have to Disclose Spent Convictions

Learn when spent convictions and cautions may still need to be disclosed under the Exceptions Order, which roles are covered, and how Standard or Enhanced DBS checks can reveal this information.

There are important exceptions where spent cautions and convictions may still need to be disclosed.

These exceptions are listed in:

  • The Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975.

They cover jobs and activities where fuller criminal record information is relevant, for example:

  • Roles involving a risk to children

  • Roles involving a risk to vulnerable adults or others in vulnerable circumstances

  • Certain sensitive areas of work, such as specific regulated professions, security, or high-trust positions

In these situations:

  • You are normally required to undergo a Standard or Enhanced DBS Check.

  • Those higher-level checks can show certain spent convictions and cautions, in line with the Exceptions Order and DBS filtering rules.
